Terms of Service
Terms of Service
By using our services, you acknowledge and agree to the following terms:
1. Your Agreement With BP Tools LLC
These terms, along with those outlined in the Global Express Guaranteed Service Guide and the International Mail Manual (IMM), form the complete agreement between you (the shipper) and BP Tools LLC, including our representatives. When you hand over a package to us, you agree to these terms not only for yourself but for anyone else with a legal interest in the shipment. These terms also apply to any third parties we may work with to handle, transport, or deliver your package. No employee or agent of BP Tools LLC is authorized to alter or override these terms. In the event of a conflict between the Air Waybill (shipping label), Service Guide, or IMM, the Service Guide will take precedence, followed by the IMM.
2. Definition of a Shipment
A "shipment" includes all items transported under a single shipping label, not just individual documents or packages. You confirm that all information provided is complete and accurate. Shipments may be transported by various methods, including by air or ground, and using third-party carriers.
3. Your Responsibilities
You are responsible for ensuring that each item is properly described, packaged, labeled, and suitable for transport. All charges—including shipping fees, surcharges, customs duties, taxes, penalties, and legal costs—are your responsibility, especially if we advance those costs on your behalf.
4. Acceptable Items
We transport both documents ("DOC") and non-documents ("NON-DOC"), but certain restrictions apply depending on the destination country. Shipments must not exceed a total value of USD $2,499. NON-DOC shipments may be inspected.
5. Prohibited Items
We do not accept items classified as hazardous materials or restricted articles by the Department of Transportation (DOT), the International Air Transport Association (IATA), or the International Civil Aviation Organization (ICAO). This also includes items like cash and other prohibited contents listed in our Service Guide and the IMM.
6. Customs Clearance
By using our service, you authorize us and/or our partners to act as your agent for customs purposes. This includes assigning a broker to clear your shipment. You are responsible for ensuring your shipment complies with all relevant import, export, and customs regulations and for supplying all necessary documentation. We are not responsible for losses due to noncompliance.
7. Export Regulations
You certify that all information provided regarding exportation is accurate. You confirm that the shipment doesn't require filing of Electronic Export Information (EEI). Knowingly providing false information may result in civil or criminal penalties under U.S. law.
8. Documentation Corrections
If your paperwork is incomplete or incorrect, you allow us (where permitted by law) to make necessary corrections to complete the shipment process. However, we are not obligated to do so and are not liable for any errors or outcomes related to this assistance. Any changes do not affect the applicability of these terms.
9. No Money-Back Guarantee
We do not provide any form of a money-back guarantee under any circumstances.
10. Claims for Loss or Damage
If your shipment is lost or damaged, you may file a claim with our partner agents. However, we are not responsible for resolving or compensating these claims.
11. Insurance
We do not offer insurance coverage. If insurance is needed, please contact the relevant agent directly.
12. Delivery Delays
We and our partners will attempt to deliver on schedule, but we are not responsible for any losses or damages resulting from delays, regardless of the cause.
13. Uncontrollable Events
We are not liable for loss, damage, or delays caused by events outside our control. These may include natural disasters, wars, strikes, acts of terrorism, customs delays, legal issues, or issues with third parties involved in the shipment process. We are also not responsible for damage to electronic or photographic materials caused by magnetic or electrical interference.
14. Indirect and Consequential Losses
We are not liable for indirect, incidental, or consequential damages—such as lost profits, revenue, business, or data—even if we are found to be at fault.
15. Illegal Use of Services
You may not use our services for any unlawful purposes. You are solely responsible for the contents of your shipment. If illegal activity is suspected, we will cooperate fully with law enforcement agencies.
16. False Information and Inspections
Submitting false or fraudulent information may lead to imprisonment or fines. We or authorized government agencies reserve the right to inspect your NON-DOC shipments at any time.
17. Governing Law and Validity
If any part of these terms is found to conflict with applicable law or international agreements, that part will be limited or removed to the extent necessary, but the rest of the terms will remain valid. The place of departure is considered to be the sender’s address, and the destination is the recipient’s address, as listed on the shipping label.
You also agree to comply with the terms and conditions of our shipping partners. You can review their terms here:
